29 CFR 1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a) On or about December 23, 2025, at the worksite located at 3006 Stone Fence Place, Green Bay, Wisconsin; employees were exposed to eye or face hazards from flying particles and projectiles while using a handheld cut-off saw (STIHL TS 420) to cut limestone without any form of eye or face protection.

Construction Reference: 29 CFR 1926.59 Note: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200 of this chapter. 29 CFR 1910.1200(g)(8): The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.) a) On or about and at times prior to December 23, 2025, at the worksite located at 3006 Stone Fence Place, Green Bay, Wisconsin; the employer did not maintain a safety data sheet (SDS) or material safety data sheets (MSDS) in the workplace for each hazardous chemical which they used, such as but not limited to limestone, exposing employees to the hazards associated with respirable crystalline silica.

29 CFR 1926.1153(d)(2)(i): The employer shall assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section. On or about and at times prior to December 23, 2025, at the worksite located at 3006 Stone Fence Place, Green Bay, Wisconsin; the employer did not assess the exposure of employees who are or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level, exposing employees to the hazards associated with respirable crystalline silica in the following instances: a) When employees were cutting limestone with a handheld cut-off saw. The material safety data sheet (MSDS) stated that the limestone contained approximately >1% crystalline silica. b) When an employee emptied a hopper containing a Portland Lime Mortar. One bulk sample of Portland Lime Mortar contained 10% crystalline silica.
