29 CFR 1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) On or about December 22, 2025, and at times prior, the employer did not ensure that inspections of adjacent areas, excavations and the protective systems were made by a competent person to ensure hazards were mitigated prior to allowing employees entrance to the trench. Employees conducting water utility construction were exposed to cave-in hazards while working in an unprotected trench and without a safe means of access or egress. Tab Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(1) which was contained in OSHA inspection number 1614850, citation number 1, item number 1a and was affirmed as a final order on November 15, 2022, with respect to a workplace located Near 2340 Faculty Dr, USAF Academy, CO 80840.
