OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and crushed-by hazards. (a) Load Out Annex - On or about December 22, 2025, the employer did not ensure safe operation of a Sky Track JLJ 8042 forklift and exposed employees to struck-by and crushed-by hazards, in that the a forklift operator did not wear the seatbelt while the forklift was in motion. (b) Load Out Annex - On or about December 22, 2025, the employer did not ensure safe operation of a JCB 507-42 forklift and exposed employees to struck-by and crushed-by hazards, in that the a forklift operator did not wear the seatbelt while the forklift was in motion.
