29 CFR  1910.134(c)(2)(ii):The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a)Industrial Welding & Repair, Inc. 352 N. Atlantic Avenue Clayton, NJ 08312: On or about 12/30/2025, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures . The employer allowed the welders to voluntarily wear a 3M 6502 half face elastomeric respirator, when welding or grinding in the field or in the warehouse   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

Atlantic Avenue Clayton, NJ 08312: On or about 12/30/2025,  employees provided with a 3M 6502 half face elastomeric respirator for voluntary use were not provided with the information contained in Appendix D.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

Atlantic Avenue Clayton, NJ 08312: On or about 12/30/2025, the employer did not develop and implement a hazard communication program to include all the provisions in 29 CFR 1910.1200(e)(1). Employees including but not limited to the welders that were required to work with hazardous chemicals including but not limited to TNEMEC Paint, Director to Metal BEHR paint, stainless steel welding rods, and carbon steel welding wires.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
