29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) New residential construction located at 6909 Nipton Xing, Flowery Branch, GA 30542, Roof: On or about January 6, 2026, the employer exposed employees to fall hazards of approximately 21 feet to the lower ground level, in that a fall protection system was not provided while employees were engaged in house wrapping activities on a pitched roof greater than 4/12.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) New residential construction located at 6909 Nipton Xing, Flowery Branch, GA 30542, Roof: On or about January 6, 2026, the  employer exposed employees to fall hazards of approximately 21 feet to the lower ground level, in that the ladder used to access the roof of the structure was not extended at least three feet above the upper landing surface or secured to prevent accidental movement during use.
