29 CFR  1910.23(d)(4): The employer did not ensure that the side rails of through or sidestep ladders extend at least 42 inches (1.1 m) above the top of the access level or landing platform served by the ladder:    a)  On or about January 6, 2026, and at times prior, the employer, Fitness Member Services, LLC dba Vasa Fitness, did not ensure employees were protected from fall hazards of approximately 22 feet when accessing the roof area above the Pump Room using a fixed ladder.  When performing maintenance operations on the roof area, employees were required to use the fixed ladder when the side rails terminated in the ladderway approximately 1 foot below the roof access level.  This condition exposed employees to fall hazards.

29 CFR  1910.28(b)(3)(iv): The employer did not provide that each employee be protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used:  a)  On or about January 6, 2026, and at times prior, the employer, Fitness Member Services, LLC dba Vasa Fitness, did not ensure employees were protected from fall hazards into a ladderway hole at least 22 feet above the lower ground level.  Employees were required to use a vertical, fixed ladder in the Pump Room to access the flat roof area during the performance of maintenance operations.  The ladderway entrance point to the flat roof area was not guarded on all sides by guardrails and self-closing gates or offsets.  This condition exposed employees to fall hazards.

29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) On or about January 6, 2026, and at times prior, the employer, Fitness Member Services, LLC dba Vasa Fitness, did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performed servicing or maintenance work on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury. In the Pump Room, employees were required to perform maintenance work on pool and spa systems equipment, specifically pressurized sand filters and electric pumps. The employer required employees to perform this work without training and in the absence of energy control procedures to ensure the equipment was isolated from all energy sources and rendered inoperative. During maintenance operations on this equipment, employees were exposed to hazards from unexpected equipment start-ups, as well as struck-by hazards from stored pressure release.

During maintenance operations on this equipment, employees were exposed to hazards from unexpected equipment start-ups, as well as struck-by hazards from stored pressure release.
