On or about February 27, 2026, for a jobsite located at 2470 West Mason Street in Green Bay, Wisconsin, the employer has not provided the Agency with abatement certification documentation demonstrating the corrective actions taken to abate the hazards related to fall protection during flat roof work, issued on January 29, 2026, have been abated.

29 CFR 1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On or about January 7, 2026, at a jobsite located at 2470 West Mason Street in Green Bay, Wisconsin, three employees of Kevin Robert Romero dba Romero's Roofing Services LLC used an articulating boom lift to access and egress a commercial low slope roof at a roof line and was not connected by lanyard and body harness exposing employees to fall hazards greater than 25 feet.

29 CFR 1926.501(b)(10):"Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted. On or about January 7, 2026, at a jobsite located at 2470 West Mason Street in Green Bay, Wisconsin, four employees of Kevin Robert Romero dba Romero's Roofing Services LLC were performing commercial roofing activities at the edge of a flat roof without any form of conventional fall protection while exposed to fall hazards greater than 25 feet.
