29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: On or about and at times prior to January 2, 2026, employees of J&J Boring Inc. were installing sanitary sewer pipes on the Gravois Creek Sanitary Relief Project located at 9410 Sappington Road, Saint Louis, Missouri. The competent person did not ensure employees were removed from working inside two excavation sites when hazardous conditions were identified. The hazardous conditions in the excavations included, but not limited to, the use of steel road plates in the protective system to extend the vertical height, steel road plates placed to lean on the spreaders of the protective system, and more than two feet of unsupported soil was excavated below the bottom of the shield.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about and at times prior to January 2, 2026, employees of J&J Boring Inc. worked on the Gravois Creek Sanitary Relief Project located at 9410 Sappington Road, Saint Louis, Missouri. The employer did not protect employees using an adequate protective system when working in two excavation sites with depths ranging from 17.5 to 23 feet. Steel road plates were used in a manner that placed lateral loads onto the trench shields which were not included in the original design calculations.

29 CFR 1926.652(g)(2): Excavations of earth material to a level greater than 2 feet (.61m) below the bottom of a shield was permitted: On or about January 2, 2026, and times prior to, employees of J&J Boring Inc. worked from two excavations sites while installing sanitary sewer pipes for the Gravois Creek Sanitary Relief Project located at 9410 Sappington Road, Saint Louis, Missouri. At these sites the employer permitted employees to enter and perform work without ensuring the shielding system was no more 2 feet from the bottom of the excavation. Employees were exposed to unshielded soil at the bottom of the excavation which ranged in heights of 3 feet to 8 feet.
