OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck by and crushing hazards.    a) On January 7, 2026, and times prior, at 117 Beaver Avenue, Wishek, ND, employees were exposed to struck-by and crushing hazards while standing directly in front of vehicles to guide them onto the BendPak Commercial Grade Four-Post Automotive Lift.    Abatement Note: Among other methods, feasible and acceptable means of abatement would be for the employer to develop, implement and enforce written safe loading procedures for automotive lifts that: (1) require spotters to stand outside the lift zone and never in the direct path of the vehicle being loaded, as outlined in the operation manual for the HDS-14X 4 post lift, ANSI/ALI ALOIM: 2020, and the Lifting It Right safety manual (2nd ed., p.14); and (2) identify conditions under which a vehicle shall not be driven onto the lift, such as, but not limited to, known or suspected brake failure, repeated engine stalling, or other mechanical issues affecting vehicle control, and specify the alternative loading methods to be used in those circumstances.
