29 CFR  1910.28(b)(1)(i):(1) Unprotected sides and edges.  (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:    (a)	On or about January 13, 2026, the employer did not ensure that employees working on stacks of tires at heights of approximately 4 to 6 feet were protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. As a result, employees standing on tire stacks to conduct inventory counts were exposed to fall hazards from unprotected sides or edges.  (b)	On or about January 13, 2026, the employer did not ensure that employees standing on the elevated forklift forks at heights of approximately 4-6 feet were protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. As a result, employees standing on forklift forks to load delivery trucks and conduct inventory counts were exposed to fall hazards from unprotected sides or edges.  (c)	On or about January 13, 2026, the employer did not ensure that employees operating a Crown Order Picker SP 3000 at heights of approximately 18 feet were protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. As a result, employees conducting inventory counts were exposed to fall hazards from unprotected sides or edges.

29 CFR  1910.132(d)(1):The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:  On or about January 13, 2026, the employer did not conduct and certify a workplace hazard assessment to determine whether fall protection personal protective equipment was required for employees operating a Crown Order Picker SP 3000. The manufacturer requires the use of a personal fall arrest system when the order picker is operated. Employees operated the order picker at heights of approximately 18 feet above the lower level without wearing a body harness and lanyard attached to an approved anchorage point. As a result, employees were exposed to a fall hazard of approximately 18 feet.

29 CFR  1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about January 13, 2026, the employer did not ensure that employees operating Komatsu FG25ST-14 forklift trucks, Mitsubishi FGC25 cushion-tire forklifts, Toyota 50-8FGCU18 internal combustion cushion forklifts, and a Crown Order Picker SP 3000 had successfully completed the required training and evaluation to demonstrate competency prior to operating powered industrial trucks. As a result, employees were exposed to hazards associated with powered industrial truck operations, including struck-by, crushing, tip-over, and pinch-point hazards.

29 CFR  1910.178(m)(3):Unauthorized personnel shall not be permitted to ride on powered industrial trucks. A safe place to ride shall be provided where riding of trucks is authorized.  On or about January 13, 2026, the employer did not ensure that employees were prohibited from riding on the forks of Komatsu FG25ST-14 forklift trucks and Mitsubishi FGC25 cushion-tire forklifts while loading delivery trucks and performing inventory activities. As a result, employees were exposed to crushing and struck-by hazards due to unstable positioning, forklift movement, and shifting materials during these activities.
