29 CFR 1910.28(b)(3)(i): The employer must ensure each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following; covers, guardrail systems, safety net systems, travel restraint systems or personal fall arrest systems: On or about January 14, 2026, at a facility located at 502 E. Linden Street in Abbotsford, Wisconsin; the employer did not ensure that employees were protected from falling through a floor hole in Wastewater Treatment Plant 2. The floor hole, used to wash membrane units, was approximately 5-feet wide by 7-feet long by 12-feet deep. On January 14, 2026, the floor of Wastewater Treatment Plant 2 was covered by approximately 2-feet of foam and an employee attempting to eliminate the foam fell into the unprotected floor hole.

29 CFR 1910.29(b)(13)(i): When guardrail systems are used around holes that serve as points of access (such as ladderways), the guardrail system opening shall have a self-closing gate that slides or swings away from the hole, and is equipped with a top rail and midrail or equivalent intermediate member that meets the requirements in paragraph (b) of this section, or is offset to prevent an employee from walking or falling into the hole: On or about January 14, 2026, at a facility located at 502 E. Linden Street in Abbotsford, Wisconsin; in Wastewater Treatment Plant 2, the employer did not ensure that the point of access to the DAF Tank platform consisted of a self-closing gate, exposing employees to fall hazards of approximately seven feet to the ground. Abbyland Foods, Inc. was previously cited for a violation of this occupational safety and health standard 1910.29(b)(13), which was contained in OSHA inspection number 1639153, citation number 1, item number 6 and was affirmed as a final order on June 20, 2023, with respect to a workplace located at 502 E. Linden Street in Abbotsford, Wisconsin.
