29 CFR 1910.101(b):The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6: a) On or about January 13, 2026, and at times prior, employees were exposed to gas cylinder projectile hazards. The employer failed to ensure a carbon dioxide cylinder next to the liquor closet by the server station was secured and did not pose a risk of being knocked over. The cylinder was found free standing, without being secure, next to the liquor closet door where it could potential get knocked over by employees entering or leaving the closet.

29 CFR 1910.22(a)(3): The employer did not ensure that walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice. a) On or about January 13, 2026, and at times prior, servers, runners, and any employees passing through the main dining area or bar area were exposed to tripping hazards. The employer failed to ensure the rubber flooring used throughout the entire dining and bar area was securely adhered to the flooring and not protruding in a way that causes tripping hazards. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
