29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles and debris.  a) New construction located on Lot #83 at Mulberry Creek Way, Union Heights subdivision Flowery Branch, GA 30542: On or about 01/14/2026, the employer exposed employees to struck-by hazards while operating saws and pneumatic nail guns, in that protective eyewear was not provided to employees using these tools at 180 PSI while engaged in framing activities.  b) New construction located on Lot #85 at Mulberry Creek Way, Union Heights subdivision Flowery Branch, GA 30542: On or about 01/14/2026, the employer exposed employees to struck-by hazards while operating saws and pneumatic nail guns, in that protective eyewear was not provided to employees using these tools at 180 PSI while engaged in framing activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) New construction located on Lot #83 at Mulberry Creek Way, Union Heights subdivision Flowery Branch, GA 30542: On or about 01/14/2026, the employer exposed employees to fall hazards of 18-feet, 5-inches to the lower concrete surface, in that a fall protection system was not provided to employees engaged in framing activities.  b) New construction located on Lot #85 at Mulberry Creek Way, Union Heights subdivision Flowery Branch, GA 30542: On or about 01/14/2026, the employer exposed employees to fall hazards of 18-feet, 5-inches to the lower concrete surface, in that a fall protection system was not provided to employees engaged in framing activities.

29 CFR  1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for an employee, and did not comply with all other pertinent requirements of this subpart before that employee began the work that necessitates the fall protection:   a) On or about January 14, 2026, at the new construction site located on Lot #85, Mulberry Creek Way, Union Heights subdivision, Flowery Branch, GA 30542, employees were exposed to a fall hazard of approximately 18 feet 5 inches to a lower concrete surface. While engaged in framing activities as an employee used a fall protection system that was improperly secured consisting of a rope tied in a knot to the employee's back and another knot tied to the trusses as an anchor point.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.   a) On or about January 14, 2026, at the new construction site located on Lot #85, Mulberry Creek Way, Union Heights subdivision, Flowery Branch, GA 30542, employees were exposed to a fall hazard of approximately 10 feet 4 inches to a lower concrete surface. A Werner extension ladder used for access and egress to the second floor was damaged, with multiple broken rungs and the left foot missing, creating a risk of slipping while the ladder was erected and in use.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:  a) On or about January 14, 2026, at the new construction site located on Lot #83, Mulberry Creek Way, Union Heights subdivision, Flowery Branch, GA 30542, employees were exposed to a fall hazard of approximately 18 feet 5 inches to a lower concrete surface.
