29 CFR  1910.29(b)(1): The employer did not ensure that  guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section).  a) For the platform at the dust collector's auger, on or about 01/13/2026, the employer exposed employees to fall hazards of approximately 12 feet, in that, the top height of the auger cover that served as a guardrail on its walking/working surface platform was only approximately 31 inches above the platform.

29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) For the Tuckerbilt facility at 400 County Road 468, Leesburg, FL 34748, on or about 01/13/2026, the employer exposed employees to laceration/amputation hazards, in that, employees performed maintenance on equipment such as, but not limited to, a sand collection system and associated auger with hazardous energy sources of 220VAC or 480VAC electrical power and moving parts being present, and a program consisting of an energy control procedure, employee training and periodic inspections was not present.

29 CFR  1910.147(d)(4)(i):Lockout or tagout devices were not affixed to each energy isolating device by authorized employees:  a) For the Tuckerbilt facility at 400 County Road 468, Leesburg, FL 34748, on or about 01/13/2026, the employer exposed employees to laceration/amputation hazards, in that, lockout tagout devices were not applied to the energy isolating disconnect for the sand blasting sand collection system and its associated auger prior to maintenance work being done on the equipment.
