29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace.  On or about December 16, 2025, and at times prior thereto and thereafter, in the north shop of a concrete pipe manufacturing facility, employees required to wear respiratory protection have not received the required respiratory medical evaluation.

On or about December 16, 2025 and at times prior thereto and thereafter, in the north shop of a concrete pipe manufacturing facility, employees required to wear respiratory protection have not received the required respiratory fit test.

29 CFR  1910.1000(a)(2): Employees were exposed to an airborne concentration of Carbon Monoxide listed in Table Z-1 in excess of the 8-hour Time-Weighted Average concentration of 50 parts per million particles of air (50 ppm) for any 8-hour work shift of a 40-hour work week and attenuated accordingly for extended work shifts in extended work weeks.  On or about December 10, 2025, in the North shop of the facility, employees were performing work activities in an area where a propane-powered heater was being used inside the building without adequate ventilation or engineering controls to prevent the accumulation of carbon monoxide to hazardous levels that exceed the applicable PEL.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area.  On or about December 16, 2025, in the North shop of the facility, employees using crystalline silica containing materials throughout the work shift have not been provided with effective information and training on crystalline silica.
