OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from damaged or overloaded industrial racking systems: a) Aisles 1-8: On or about January 15, 2026, industrial racking systems, in use, were not anchored to the floor, exposing employees to crushing hazards. b) Warehouse: On or about January 15, 2026, industrial racking systems, in use, did not have load ratings exposing employees to potential crushing hazards from overloading. c) Aisle 1: On or about January 15, 2026, industrial racking systems, in use, were not installed with the top shelf, exposing employees to potential crushing hazards from a lack of stability.
