29 CFR  1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:  a) Worksite was located at 7 & 9 West Avenue, Atlantic Highlands, NJ 07716:    Five workers were exposed to potential fall hazards of approximately nine feet to ground from the extension ladder they were using to access and egress the roof of the building  they were working on.  The ladder was improperly set up as it did not extend three feet above its landing point and the ladder was not properly secured at its top.   Violation was observed on or about January 15, 2026.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) Worksite was located at 7 & 9 West Avenue, Atlantic Highlands, NJ 07716:  Five workers were exposed to fall hazards of approximately nine feet from the eave to ground as they were ripping off the roof of a commercial building without utilizing fall protection.  Violation was observed on or about January 15, 2026.  Space Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1704724, citation number 1, item number 1 and was affirmed as a final order on 8/2/2024, with respect to a workplace located at 102 Old Bridge Drive, Howell, NJ 07731.  Space Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1708743, citation number 1, item number 1 and was affirmed as a final order on 6/24/2024, with respect to a workplace located at 94 15th Avenue, Belmar, NJ 07719.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
