29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) On or about January 15, 2026, 210 Bellehurst Drive, Lot #13, Warrior, AL; employee(s) operated pneumatic nail guns without utilizing eye or face protection while performing framing activities on a new single family residential home.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) On or about January 15, 2026, 210 Bellehurst Drive, Lot #13, Warrior, AL; employee(s) operated pneumatic nail guns without utilizing an adequate fall protection system while performing framing activities on the roof of a new single family residential home.  Mario Flores Vazquez was previously cited for a violation of this occupational safety and health standard  29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1812873, citation number 1, item number 1a and was affirmed as a final order on July 02, 2025 with respect to a workplace located at 543 Avondale Lane, Pell City, AL 35128.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) On or about January 15, 2026, 210 Bellehurst Drive, Lot #13, Warrior, AL; employee(s) operated pneumatic nail guns without being trained to recognize fall hazards involved with conducting framing activities while forming a single family new residential roof in construction.   Mario Flores Vazquez was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1812873, citation number 1, item number 1b and was affirmed as a final order on July 02, 2025 with respect to a workplace located at 543 Avondale Lane, Pell City, AL 35128.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
