OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lift parts:  a) Bay 1, Steve Shannon Tire Company, Inc., 30 Groton Avenue, Cortland, NY 13045, on or about 1/21/2026, a four-post surface mounted Rotary Lift, Model: SM14N102Y, SN: KSC18J0006, was operated without being inspected and certified within the last 12 months, last inspection was completed on 8/15/2024.  b) Bay 2, Steve Shannon Tire Company, Inc., 30 Groton Avenue, Cortland, NY 13045, on or about 1/21/2026, a two-post surface mounted Rotary Lift, Model: I12N301BBL, SN: NFY18G0009, was operated without being inspected and certified within the last 12 months, last inspection was completed on 8/15/2024.  c) Bay 3, Steve Shannon Tire Company, Inc., 30 Groton Avenue, Cortland, NY 13045, on or about 1/21/2026, a two-post surface mounted Rotary Lift, Model: SPOA9-200, SN: AFM99C2837, was operated without being inspected and certified within the last 12 months, last inspection was completed on 8/15/2024.  d) Bay 5, Steve Shannon Tire Company, Inc., 30 Groton Avenue, Cortland, NY 13045, on or about 1/21/2026, a two-post surface mounted Forward Lift, Model: DP10AN100BBL, SN: NEP11E0033, was operated without being inspected and certified within the last 12 months, last inspection was completed on 8/15/2024. Lift was observed with the guard missing on the safety lock.  e) Bay 6, Steve Shannon Tire Company, Inc., 30 Groton Avenue, Cortland, NY 13045, on or about 1/21/2026, a two-post surface mounted Rotary Lift, Model: SPOA10N16G0, SN: CM123I0215, was operated without being inspected and certified within the last 12 months, no inspection sticker was present on the lift, lift was installed 11/1/2024.  f) Bay 7, Steve Shannon Tire Company, Inc., 30 Groton Avenue, Cortland, NY 13045, on or about 1/21/2026, a two-post surface mounted Rotary Lift, Model: DP10AN200BBL, SN: NFF13K0041, was operated without being inspected and certified within the last 12 months, last inspection was completed on 8/15/2024.  g) Bay 8, Steve Shannon Tire Company, Inc., 30 Groton Avenue, Cortland, NY 13045, on or about 1/21/2026, a four-post surface mounted Rotary Lift, Model: SM14N001, SN: KFA08I0005, was operated without being inspected and certified within the last 12 months, last inspection was completed on 8/15/2024.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet:   a) Between Bay 3 and Bay 4, Steve Shannon Tire Company, Inc., 30 Groton Avenue, Cortland, NY 13045, on or about 1/21/2026; Compressed oxygen cylinders and acetylene cylinders (fuel-gas) were stored within inches of each other.
