29 CFR  1910.119(j)(5): Equipment deficiencies. The employer shall correct deficiencies in equipment that are outside acceptable limits (defined by the process safety information in paragraph (d) of this section) before further use or in a safe and timely manner when necessary means are taken to assure safe operation.  (a) On or about January 21, 2026, and at times prior, the refrigeration system was not adequately maintained to protect employees from an uncontrolled release of anhydrous ammonia in that pressure relief valves (PRVs) were not being inspected or replaced every five years. This includes a Cyrus Shank PRV on the Comp 104 compressor that connected the thermosyphon to the oil separator was scheduled to be replaced in November 2003, and was past the required replacement date by 22 years. This condition exposed employees to an overpressure event and struck by hazards.  (b) On or about January 21, 2026, and at times prior,  the employer had not corrected missing insulation on the Recirculator (V101) control level line, insulation from V101 to AV247, and insulation from AV631 to AV633.  The pipes had rusting due to the missing insulation. Corrosion related pipe failure would result in release from the ammonia refrigeration system. Release of anhydrous ammonia refrigerant from the system exposes employees to chemical hazards such as chemical burns, inhalation hazards and/or asphyxiation.  (c) On or about January 21, 2026, and at times prior, the employer had not reinstalled the drain caps on Comp 102, Comp 103, and oil pot of Recirculator (V101) exposing employees to a release of anhydrous ammonia refrigerant from the system, and exposes employees to chemical burns, inhalation hazards and/or asphyxiation.

29 CFR  1910.119(g)(1)(i): Each employee presently involved in operating a process, and each employee before being involved in operating a newly assigned process, shall be trained in an overview of the process and in the operating procedures as specified in paragraph (f) of this section. The training shall include emphasis on the specific safety and health hazards, emergency operations including shutdown, and safe work practices applicable to the employee's job tasks.  (a) On or about January 21, 2026, and at times prior, the employer had not trained the boiler technicians in process safety management (PSM) who oversee and monitor the anhydrous ammonia refrigeration system. This exposes employees to chemical hazards associated with anhydrous ammonia such as chemical burns, inhalation hazards and/or asphyxiation.

29 CFR  1910.119(f)(2): Operating procedures shall be readily accessible to employees who work in or maintain a process.  (a) On or about January 27, 2026, the employer had not ensured that employees who oversee and monitor the anhydrous ammonia refrigeration system had access to the standard operating procedures. The procedures were not readily available to the employees, in that the employees had not known there were more than one operating procedure for the anhydrous ammonia refrigeration system. This exposes employees to vessel over pressure events, and to struck by hazards, chemical hazards and inhalation and/or asphyxiation hazard associated with operating the anhydrous ammonia refrigeration system.

29 CFR  1910.119(e)(3)(v):The process hazard analysis shall address facility siting;  (a) On or about January 21, 2026, and at times prior, the employer had not addressed within the processes hazard analysis (PHA) facility siting, specifically the boiler system located within the ammonia refrigeration system engine room. The boiler system is in close proximity of the ammonia system and the employer had not address how the boiler system could affect the ammonia system in case of a fire/explosion. This exposes employees to chemical hazards associated with anhydrous ammonia such as chemical burns, inhalation hazards and/or asphyxiation.
