29 CFR 1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) On or about January 17, 2026, an untrained employee was allowed to operate the company's Octane FD30 forklift (serial no. 222013326) without having received formal instruction, including operator evaluation to determine the retention of the information. Untrained operator(s) and others working in the immediate area were potentially exposed to crushing and/or struck-by hazards.
