29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. a) 1002 St Georges Ave. Avenel, NJ 07001 Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on concrete floor were exposed to the hazard of crystalline silica inhalation due to lack of the employer's failure to implement engineering controls prescribed in Table-1 for control of dust. Employee(s) used a portable power saw without integrated water delivery system for continuously feeding water to the blade while cutting exterior floor surface(s). Conditions noted on or about January 22, 2026.

29 CFR 1926.1153(d)(2)(i):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section: a) 1002 St Georges Ave. Avenel, NJ 07001 Employee(s) including operator(s) of hand-held power saw and other laborer(s) working on sidewalk were exposed to the hazard of crystalline silica inhalation due to the employer's failure to fully and properly implement dust control method(s) prescribed for task(s) listed in Table-1 when working on materials containing crystalline silica. Employee(s) used a portable power saw without integrated water delivery system for continuously feeding water to the blade while cutting concrete sidewalk(s). Where the control measures prescribed in Table-1 were not implemented, the employer did not assess employees' exposure to crystalline silica through air monitoring. Conditions noted on or about January 22, 2026.
