29 CFR  1910.1200(e)(1):The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:  a) At the facility 150 West Jericho Turnpike NY 11746, On or about January 22nd, 2026 the employer did not develop, implement and maintain a hazard communication program for employees engaged in transmission repair. Employees utilized flammable products such as but not limited to motor oil, hydraulic oil, and paint thinner which contains ethylbenzene, xylene, methyl acetate and titanium dioxide.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19

29 CFR  1910.1200(g)(1):Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use.  a) At the facility 150 West Jericho Turnpike NY 11746, On or about January 22nd, 2026 the employer did not have safety data sheets for employees engaged in auto maintenance and transmissions repair. Employees utilize products daily such as but not limited to motor oil, hydraulic oil and transmission fluid.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19

29 CFR  1910.1200(h)(1):The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area:  a) At the facility 150 West Jericho Turnpike NY 11746, On or about January 22nd, 2026 employee engaged in auto maintenance and transmission repair utilize products such as but not limited to motor oil, hydraulic oil and transmission fluid daily and were not provided with information and training on hazardous chemicals in the workplace.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19
