29 CFR  1926.451(c)(2)(i): Employer failed to ensure scaffold footings were level, sound, rigid and capable of supporting the loaded scaffold without settling or displacement:  a) New home construction located on Lot #35 - 39 at 3215 New Mcland Rd. Powder Springs GA. 30127. Back side of the structure: On or about January 20, 2026, the employer exposed employees to a fall hazard of approximately 13-feet in that the work platform (pump-jack scaffold) did not have mud seals under the support pole. Pole showed signs of shifting/sinking into the earth beneath.

29 CFR  1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  New townhome construction located on Lot #35 - 39 3215 New Mcland Rd Powder Springs GA. 30127.  Rear side of the structure: On or about January, 20, 2026, the employer exposed employees to fall hazards of 13ft to the lower level, in that fall protection was not enforced while employees were working from a pump jack scaffold used to install siding .

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   New townhome construction located on Lot #35 - 39 3215 New Mcland Rd Powder Springs GA. 30127.  Rear side of the structure: On or about January, 20, 2026, the employer exposed employees to fall hazards of 19ft from the eave to the lower level, in that fall protection was not enforced while employees employees engaged in roofing activities. CSHO observed two employees on the roof,  neither were wearing fall protection.
