OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to struck-by hazards during operation of a loader backhoe.  a) Kingsfort Builders, Inc.,  at 1725 Coon Hill Road, Skaneateles, New York, 13152.  On or about January 22, 2026, the employer was operating a JCB model 3CX Compact loader backhoe that was not adequately inspected and maintained, in that it had visible defects including, but not limited to damaged and improperly adjusted mirrors and a damaged door, exposing an employee working nearby to struck-by hazards.

29 CFR  1926.602(a)(9)(ii): Earth moving or compacting equipment which had an obstructed view to the rear was operated in reverse gear; such equipment did not have in operation a reverse signal alarm distinguishable from the surrounding noise level or did an employee signaled that it is safe to do so.  a) Kingsfort Builders, Inc.,  at 1725 Coon Hill Road, Skaneateles, New York, 13152.  On or about January 22, 2026, the employer was operating a JCB model 3CX Compact Loader Backhoe that did not have an operational reverse signal alarm or have an employee signaling that it was safe to reverse and struck and killed a sub-contracted employee.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury.  a) Kingsfort Builders, Inc.,  at 1725 Coon Hill Road, Skaneateles, New York, 13152.  On or about January 22, 2026, the employer did not ensure that each employee, including sub-contracted employees, were trained in the recognition and avoidance of unsafe conditions such as working near an operating JCB 3CX Compact Loader Backhoe, such as awareness of operator blind spots, stopping distance, or making eye contact with the equipment operator.  On January 22, 2026, a sub-contracted employee, who was working behind the backhoe installing a gas line, was fatally injured when the backhoe struck him and crushed him between the machine and the side of the building.
