29 CFR 1910.23(b)(13): The employer did not ensure that no employee carries any object or load that could cause the employee to lose balance and fall while climbing up or down the ladder. (a) On or about February 19, 2026, employees utilized a 10-foot A-frame ladder and a 6-foot A-frame ladder to retrieve merchandise from elevated shelving. Employees were exposed to fall hazards when they carried the merchandise down the ladder. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

(a) On and before January 23, 2026, the employer provided 6 foot A-frame ladders for employees to access hanging apparel stored on a hanging rod above a racking system with a depth of approximately 42-inches. Employees were exposed to fall hazards when standing on the top step of the A-frame ladders to reach merchandise. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. The emergency exit door in the back stockroom was blocked by pallets, carts, and merchandise. Dick's Sporting Goods, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1592885, citation number 1, item number 1, and was affirmed as a final order on January 18, 2023, with respect to the workplace located at 45 Gosling Road, Portsmouth, NH 03801.
