On or about January 30, 2026, in the warehouse, the employer failed to ensure that employees operating powered industrial vehicles were properly trained, evaluated and certified to perform the tasks in a safe manner, thereby exposing employees to struck-by hazards.

29 CFR 1910.38(a): The employer did not establish a written emergency evacuation plan for employees expected to evacuate in the event of a fire or other emergency. a. On or about January 30, 2026, at the above-mentioned workplace, the employer exposed employees to smoke, fire, burn hazards, in that, in the event of an emergency, employees did not have the requisite knowledge of what exit doors to utilize and location of assembly for accountability.
