29 CFR  1910.147(c)(1):Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  On or about December 12, 2025, the employer did not establish and implement an energy control program for the BOSS Snowplow VBX8000 V-Box Salt Spreader (Model VB14200C) before employees performed cleaning and servicing activities inside the salt spreader tank that contains an auger. Specifically, the employer did not develop or implement energy control procedures, provide employee training, or conduct periodic inspections to ensure hazardous energy was controlled. As a result, employees were exposed to the hazard of unexpected energization and movement of the auger, which resulted in an employee's arm being pulled into the equipment and sustaining serious injury.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  On or about December 13, 2025, the employer failed to report a Hospitalization incident to OSHA within the required 24-hour timeframe. The incident involved an employee who was hospitalized when they sustained severe injuries to arm while cleaning the tank of a BOSS SNOWPLOW VBX8000 V-BOX SALT SPREADER on December 12, 2025. The employer did not report the injury to OSHA until January 22, 2026.
