OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to the struck by and/or crushing hazards from falling powered industrial vehicles elevated on automotive lifts: On or about January 28, 2026, employees were using ARI-HETRA Two Post Lifts (e.g. Post 1: HDML-8, Serial No.990251; Post 2: HDML-8, Serial No. 990253) to raise and lower powered industrial vehicles for service and maintenance tasks. The lift was stopped twice while being raised and at both times the visual assessment revealed that the posts were level. While lowering the lift, the right post failed and dropped a few inches before being caught by its safety wedge. As a result of the unexpected failure, the lift's left and right lowering arms were not even exposing employees to struck-by and crushed-under hazards likely to result in serious injury.
