29 CFR  1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):  a) Dairy Filling Room - On and prior to January 13, 2026, employees reached their hands into the Dairy Case Stacker Machine - Line 1 when performing servicing and maintenance activities including, but not limited to, clearing jams of the gallons of milk and cleaning milk and other debris from the sensor eye without utilizing energy control procedures and not performing lockout/tagout (LOTO).  The employees were to follow the procedures in the Case Stacker SOP that did not clearly and specifically outline when to utilize the Lockout/Tagout procedures for the either the Gallon Caser Conveyor or the Gallon Bottle Case Stacker when clearing jams or cleaning eye sensors.

29 CFR  1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  a) Dairy Filling Room - On and prior to January 13, 2026, employees reached their hands into the Dairy Case Stacker Machine - Line 1 when performing servicing and maintenance activities including, but not limited to, clearing jams of the gallons of milk and cleaning milk and other debris from the sensor eye without utilizing energy control procedures and not performing lockout/tagout (LOTO).  The employer did not conduct an annual periodic inspection of the energy control procedure of the Dairy Case Stacker Machine - Line 1.

29 CFR  1910.147(c)(7)(iii)(B): Additional retraining was not conducted whenever the employer had reason to believe, that there were deviations from or inadequacies in the employee's knowledge or use of the energy control procedures:  a) Dairy Filling Room - On and prior to January 13, 2026, employees reached their hands into the Dairy Case Stacker Machine - Line 1 when performing servicing and maintenance activities including, but not limited to, clearing jams of the gallons of milk and cleaning milk and other debris from the sensor eye without utilizing energy control procedures and not performing lockout/tagout (LOTO).  Employees were trained in LOTO, but were reaching into the danger zone with their hands of the machine giving the employer reason to believe there were deviations from or inadequacies in the employees' knowledge or use of the energy control procedures.
