29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  (a) On or about January 15, 2026, at 646 40th Street South, Birmingham, AL 35203: The employer did allow employees to perform a task on the roof without a fall protection system.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.  (a) On or about January 15, 2026, at 646 40th Street South, Birmingham, AL 35203, the employer exposed employees to fall hazards, in that ladder training was not provided when employees were required to use a ladder to access the roof of the residential building.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a) On or about January 15, 2026, at the worksite located at 646 40th Street S, Birmingham, AL, an employees suffered a work-related injury and was hospitalized. The employer was aware of the in-patient hospitalization on January 15, 2026.
