29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: Employer failed to develop and implement a written hazard communication program at the facility located at 39560 39th Road - Gibbon, Nebraska 68840 for employees exposed to flammable and toxic chemical hazards. On or about January 30 through March 5, 2026, employees engaged in MIG welding, were exposed to chemicals including, but not limited to metal welding fumes, argon, acetylene, and propane. A written hazard communication program along with a master chemical list, was not available upon agency request.

Employer failed compile a list of the hazardous chemicals known to be present at the facility located at 39560 39th Road - Gibbon, Nebraska 68840 for employees exposed to flammable and toxic chemical hazards.
