29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  In the body shop area, employees engaged in sanding and spray painting activities were exposed to respiratory hazards and/or cardiac stress hazards when using employer required respirators. The employer did not conduct medical evaluations before requiring the employees to use half -tight fitting respirators. Employees were required to wear 3M half-mask negative pressure respirators with replaceable filters.

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:  In the body shop area, employees engaged in sanding and spray painting activities were exposed to respiratory hazards in that the employer had not provided  fit testing for employees required to use respirators.  Employees were required to wear 3 M half face mask negative pressure respirators with replaceable filters.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or were not packed or stored to prevent deformation of the facepiece and exhalation valves.  In the body shop, employees performing sanding and spray painting activities were exposed to respiratory hazards in that employer did not ensure that respirators used by employees were stored correctly.  Respirators were observed sitting on dusty work benches, and left hanging on a hook in a dusty environment.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met   At the workplace located at 5239 South 4th St in Leavenworth ,Kansas,  employees performing spray painting activities were exposed to chemical hazards in that the employer had not developed and implemented a written hazard communication program. The employees had not been provided effective information and training to recognize, evaluate, and control exposure to hazardous chemicals including but not limited to  Line-X XS-100 Resin Black which is a skin irritant (category 2), known to cause serious eye damage (category 1) and is suspected of causing lung cancer. Additionally, employees also work with Universal reducer medium which is a category 3 flammable liquid and category 2 reproductive toxin among many other chemicals.

The employees had not been provided effective information and training to recognize, evaluate, and control exposure to hazardous chemicals including but not limited to  Line-X XS-100 Resin Black which is a skin irritant (category 2), known to cause serious eye damage (category 1) and is suspected of causing lung cancer.
