NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19

29 CFR 1926.1153(i)(1): The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200), and did not ensure that each employee has access to labels on containers of crystalline silica and safety data sheets, and is trained in accordance with the provisions of HCS and paragraph (i)(2) of this section to ensure that hazards associated with cancer, lung effects, immune system effects, and kidney effects are addressed: In the alternative: CFR 1926.21 (b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her work environment to control or eliminate any hazards or other exposure to illness or injury: On or about September 28, 2025 - COEMA Carpet Inc located at 1345 6th Ave, 28th Floor, New York, NY 10105 a) Employees performing concrete scarification were exposed to the hazards of respirable crystalline silica (RCS). The employer's written exposure control plan did not include the hazards associated with exposure to silica to include cancer, lung effects, immune system effects, and kidney effects nor were the employees trained on these hazards. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19
