29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: a) On or about January 30, 2026, and at times prior, the employer, Oleo Acres Farrier Supply, Inc. d/b/a Oleo Acres Farrier and Blacksmith Supply, did not remove the Caterpillar GC15K powered industrial truck from service when it was not in a safe operating condition. Employees were required to operate and load this powered industrial truck when the front steering tires were excessively worn or damaged. This condition exposed employees to crushing hazards.
