OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of racking systems collapsing. a) Warehouse: On February 5, 2026, employees used forklifts to load material of various weights onto five multi-tiered racking systems and were exposed to the hazard of racking systems collapsing. Racks had damaged crossbeams, damaged anchor plates, missing load capacity plaques, and were not anchored to the ground. Collapse of the racking system could result in employees being struck by falling materials or structural components. NOTE: Abatement certification is required for this item.
