29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New residential construction located at 2440 Colliers Lane, Cumming, GA 30040, Roof: On or about 02/05/2026, the employer exposed employees to fall hazards of approximately 22 feet to the lower ground level, in that a fall protection system was not provided to an employee engaged in framing activities.  FLI Construction Services LLC was previously cited for a violation of this occupation safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 1812856, citation number 1, item number 1 and was affirmed as a final order date on 05/09/2025, with respect to a workplace located at 437 Tramine Way, Lot #157, Hoschton, GA 30548.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) New residential construction located at 2440 Colliers Lane, Cumming, GA 30040, Roof: On or about 02/05/2026, the employer exposed employees to fall hazards at approximately 22-feet to the lower ground level, in that a training program was not in place for employees to recognize and properly minimize the fall hazards.  FLI Construction Services LLC was previously cited for a violation of this occupation safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA Inspection Number 1718663, citation number 1, item number 3 and was affirmed as a final order date on 02/14/2024, with respect to a workplace located at Lot# 661(Twin Lakes Subdivision) located  at 398 Crystal Lake Parkway, Hoschton, GA 30548.
