29 CFR  1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  (a) On or about February 5, 2026, the employer did not develop and implement a control of hazardous energy (lock-out/tag-out) program to ensure employees have the training and procedures to follow when conducting repair and maintenance activities on equipment and processes.

29 CFR  1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  (a) On or about February 5, 2026, the employer failed to develop, document, and implement energy control procedures for equipment with multiple energy sources. This exposed employees to potential caught-in and amputation hazards from the unexpected energization of equipment.

29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  (a) On or about February 5, 2026, employees were exposed to a caught-on and struck-by hazard from the unguarded chuck on the Le BLOND lathe.

29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  (a) On or about February 5, 2026, employees engaged in metal fabrication were exposed to hazardous materials, such as but not limited to, LP gas, lubricants, and other chemicals. The employer had not developed and implemented a program which would address labeling and other forms of warnings on hazardous material containers, Safety Data Sheets, and employee information and training on the hazards associated with the hazardous materials utilized on site, which was consistent with the Global Harmonization Systems (GHS).  The written program must also contain the following: 1. A list of all hazardous materials on site; 2. The methods the employer will use to inform employees of the hazards associated with non-routine tasks involving hazardous materials, such as spills, and; 3. The method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at the site.
