29 CFR 1910.147(c)(7)(i)(B): Affected employees were not instructed in the purpose and use of the energy control procedure: 40 Willow Creek Road, Lenox, MA and at other product on-load and off-load locations: On and before February 3, 2026, driver employees were not instructed so that they understood which activities exceeded their authority during pre- and post-trip inspections or when malfunctions were discovered. On February 3, 2026, a driver employee was injured by an intermittently malfunctioning power take off shaft that started rotating while trying to make it operate. *Abatement Notes: A vehicle employer Energy Control Program shall include the following elements: - Make vehicle manufacturer repair manuals accessible to Authorized technicians. - Develop and document machine specific energy control procedures for facility/shop machines with multiple energy sources. - Train Authorized technicians to always follow manufacturer's manuals and the employer's machine specific energy control procedures. - Train drivers and all other employees that they do not troubleshoot or perform any type of maintenance or servicing activities. - Appoint authorized employees to inspect a random sample of vehicle maintenance being performed to ensure technicians follow manufacturer's instructions. - Appoint authorized employees to annually inspect each local machine specific energy control procedure for employee deviation and procedure inaccuracies during an energy control task. - Have inspectors review with each authorized employee, their responsibilities under each energy control procedure they are authorized to use. - Certify that the periodic inspections were performed by identifying the machines or equipment on which the energy control procedures were being utilized, the dates of the inspections, the employees included in the inspections, and the persons performing the inspections. *Abatement notes are intended only to provide clarity regarding existing requirements under the law or agency policies. Abatement notes do not create (or diminish) legal obligations under the Occupational Safety and Health Act.

29 CFR 1910.219(c)(2)(i): All exposed part(s) of horizontal shafting seven (7) feet or less from floor or working platform were not protected by stationary casing(s) enclosing shafting completely or by trough(s) enclosing sides and top or sides and bottom of shafting: 40 Willow Creek Road, Lenox, MA and at other product on-load and off-load locations: On and before April 1, 2026, some driver employees stood one foot away from unguarded rotating power take off shafts that were shin-high and six inches in from the truck frame, exposing them to caught in hazards.
