1926.503(c)(3):  Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  a) Jobsite: East Main Street & Maibach Lane, Lancaster, PA: On or about February 9, 2026, employees walked along a metal roof on a new construction wood frame building without a fall protection system, exposing them to a potential fall of approximately 33 feet.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

1926.454(c)(3): The employer failed to retrain employees that showed indications through work performance of not retaining the requisite proficiency:  a) Jobsite: East Main Street & Maibach Lane, Lancaster, PA: On or about February 9, 2026, employees were observed working from an elevated platform supported by the forks of a JLG/Gradall G6-42A Material Handler, which did not have guardrails erected on all open sides of the platform, exposing them to an approximate 18-foot fall hazard to the ground below.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

29 CFR  1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  a) Jobsite: East Main Street & Maibach Lane, Lancaster, PA: On or about February 9, 2026, an operator was not present at the controls of a Gradall G6-42A telehandler, leaving the forks elevated and exposing employees to an approximate 18-foot fall hazard while they worked from an elevated platform attached to the boom and supported on the forks of the Material Handler.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
