29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:   Site - An employee working from a 10 foot long custom made platform attached to a JCB all-terrain forklift was not protected from tipping, crushing, and fall hazards where the platform affected the capacity of the lift and the employer did not have manufacturer's written approval for use of the platform.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.   Site - Two employees working from a 10 foot long custom made platform that was being raised and supported by a JCB all-terrain forklift was not provided with prompt rescue ability where the employer left the all-terrain forklift elevated to the second floor level and unattended. ANSI B56.1-1969 Section 603, paragraph E requires that the load engaging means of a powered industrial truck shall be fully lowered when left unattended.

29 CFR 1926.602(c)(1)(viii)(A): The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel:   Site- An employee working from a 10 foot long custom made platform attached to a JCB all-terrain forklift was not protected from a fall of approximately 10 feet where the platform was not firmly secured to the lifting carriage or forks while it was being used to lift 2 employees.
