29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) On or about February 12, 2026, at the jobsite: employees were exposed to struck-by and engulfment hazards while working in an excavation measuring approximately 51 feet long, 17 feet wide, and 9 feet 4 inches deep, in Type C soil, near vehicular traffic, in that spoil piles were not set back at least 2 feet from the edge. The Final Site LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(j)(2), which was contained in OSHA inspection number 1841975, citation number 1, item number 1a and was affirmed as a final order on 09-17-2025, with respect to a workplace located at 110 St. Johns Pkwy Palm Bay Brevard FL 32907.
