29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. (a) On or about February 13, 2026, an employee waterproofing the backside exterior of a commercial building from a Genie aerial lift, was not protected from an approximate 13 foot fall and/or ejection hazard by using a safety harness and lanyard attached to the lift.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. (a) On or about February 13, 2026, at a jobsite located at 1686 Old School House Road, Oconomowoc, WI 53066, an employee waterproofing the exterior of a commercial building from a Genie aerial lift, was not trained to recognize fall hazards associated with working from a scaffold work.
