29 CFR  1910.178(l)(4)(ii)(B): Refresher training and evaluation was not provided to the operator when the operator was involved in an accident or near-miss incident.    a.)  DeDeavors Corporation dba DeSantis Solutions -  On or about 2/19/26, and at times prior thereto,  employees were not retrained and reevaluated when they had a near miss with the forklifts.  Near misses included, but were not limited to, piercing a box of paper goods with a fork and backing into the racking system while operating the forklift.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

DeDeavors Corporation dba DeSantis Solutions -  On or about 2/19/26, and at times prior thereto,  employees were not retrained and reevaluated every three years as required by the regulation.  Employees operate forklifts including, but not limited to, CAT Model ET4000-AC; serial #ETB1451252.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

DeDeavors Corporation dba DeSantis Solutions -  On or about 2/19/26, and at times prior thereto, pre-shift inspections of the forklifts were not being performed.  The forklifts are operated on two shifts per day.  Employees operate forklift including, but not limited to, CAT Model ET4000-AC; serial #ETB1451252.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
