29 CFR  1910.134(d)(1)(i): Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability:  a) Stone Cutting Area: On or about March 5, 2026, and at times prior, the employer exposed employees to respiratory hazards, in that the employer failed to ensure the respirator selection was based on the site specific hazards encountered for employees tasked with stone cutting granite slabs.

29 CFR  1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  a) Stone Cutting Area: On or about March 5, 2026, and at times prior, the employer exposed employees to respiratory hazards, in that the employer failed to ensure the information in Appendix D of 29 CFR 1910.134 was provided to employees voluntarily wearing N-95 respirators.

29 CFR  1910.1053(c): The employer did not ensure that no employee was exposed to an airborne concentration of respirable crystalline silica in excess of 50 ?g/m3, calculated as an 8-hour TWA:  a) Stone Cutting Area: On or about March 5, 2026, the employer exposed employees to health hazards associated with silica, in that a stone grinder employee tasked to shape granite slabs was exposed to Respirable Crystalline Silica at 69.8 µg/m3 of 8-hour TWA . This level exceeded the Permissible Exposure Limit for RCS (50 µg/m3). The exposure was derived from a sample collected for a 246-minute sampling period. Exposure calculations included a zero increment for 234 minutes not sampled.

29 CFR  1910.1053(d)(3)(i): The employer did not perform initial monitoring to assess the 8-hour TWA exposure for each employee on the basis of one or more personal breathing zone air samples that reflect the exposures of employees on each shift, for each job classification, in each work area:  a) Stone grinding area: On or about March 5, 2026, the employer exposed employees to health hazards associated with silica, in that the employer did not ensure that initial monitoring was performed for employees conducting stone cutting activities when an employee was exposed to Respirable Crystalline Silica at 69.8 µg/m3 of an 8-hour TWA. This level exceeded the Permissible Exposure Limit for RCS (50 µg/m3). The exposure was derived from a sample collected for a 246-minute sampling period. 29 CFR  1910.1053(f)(1): The employer did not use engineering and work practice controls to reduce and maintain employee exposure to respirable crystalline silica to or below the PEL, unless the employer can demonstrate that such controls are not feasible:  a) Stone Grinding Area: On or about March 5, 2026, the employer exposed employees to health hazards associated with silica, in that, the employer failed to ensure adequate engineering and work practice controls provided to reduce employees exposure to respirable crystalline silica at or below the PEL. Stone grinder tasked to shape granite slabs were exposed to Respirable Crystalline Silica at 68.9 ?g/m3 of 8-hour TWA. This level exceeded the Permissible Exposure Limit for RCS (50 ?g/m3). The exposure was derived from a sample collected for a 246-minute sampling period. Exposure calculations included a zero increment for 234 minutes not sampled.
