29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) At the shop/warehouse located at 12350 Belcher S Rd, Largo, FL 33773:  a cutter helper was exposed to continuous noise levels at 114.6 % of the allowable 8-hour TWA-Action Level (85 dBA).  The equivalent dBA of 114.6 % is 91 dBA.  The sampling was performed for 355-minutes during one shift on March 3, 2026.   b) At the shop/warehouse located at 12350 Belcher S Rd, Largo, FL 33773:  a machine operator was exposed to continuous noise levels at 67.8 % of the allowable 8-hour TWA-Action Level (85 dBA).  The equivalent dBA of 67.8 % is 87.2 dBA.  The sampling was performed for 344-minutes during one shift on March 3, 2026.    c) At the shop/warehouse located at 12350 Belcher S Rd, Largo, FL 33773:  a helper was exposed to continuous noise levels at 150.9% of the allowable 8-hour TWA-Action Level (85 dBA).  The equivalent dBA of 150.9 % is 93 dBA.  The sampling was performed for 353-minutes during one shift on March 3, 2026.    d) At the shop/warehouse located at 12350 Belcher S Rd, Largo, FL 33773:  employees were exposed to continuous noise levels at 148.9% of the allowable 8-hour TWA-Action Level (85 dBA).  The equivalent dBA of 148.9 % is 92.9 dBA.  The sampling was performed for 447-minutes during one shift on March 3, 2026.

29 CFR  1910.1053(j)(3)(i): The employer did ensure that each employee covered by this section could demonstrate knowledge and understanding of  the health hazards associated with exposure to respirable crystalline silica; specific tasks in the workplace that could result in exposure to respirable crystalline silica; specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica; the contents of this section; and the purpose and a description of the medical surveillance program required by paragraph (i) of this section:   a)  On or about February 23, 2023  at 2410 Bayshore Blvd, Tampa, FL 33629, the employer did not provide employees with information and training on silica in their work areas, at the time of their initial assignment, and whenever a new chemical or product was introduced, exposing employees to hazards associated with crystalline silica.
