29 CFR 1910.22(d)(2): The employer did not ensure that hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. The employer did not ensure that if the correction or repair cannot be made immediately, the hazard is guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired. A.) Hardinger Transfer Company Inc., DBA Hardinger Warehousing, Warehouse, On or about 2/26/26 and times prior thereto: Employees were exposed to trip and fall hazards outside of Door 13 while walking and operating forklifts. The walking working surface was damaged in that, there was a pot hole in the parking lot. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: A.) Hardinger Transfer Company Inc., DBA Hardinger Warehousing, Warehouse, On or about 2/26/26 and times prior thereto: rigging equipment including but not limited to synthetic straps were placed on the forks of the #48 Yale Model GLP155CANGBE100 Serial No. B878V02342E. "Free rigging" was being used to lift a motor and boat wrap it. The employer had not received prior written permission from the forklift manufacturer to conduct free rigging. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
