OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to Struck-by/Caught between hazards associated with damage to the structural components of storage rack systems, storage rack anchor bolt deficiencies, and a lack of information conveyed to employees on the load limits associated with storage rack systems: a) Hillandale Farms Corporation, on or about February 26th, 2026, and times prior thereto: The storage racking systems throughout the warehouse did not contain any anchor bolts to anchor the racking systems to the floor. b) Hillandale Farms Corporation, on or about February 26th, 2026 and times prior thereto: The "Coffee creamer/Cheese racking system" contained damage including but not limited to damage and displacement of the lower left horizontal bracing beam and damage/deflection of a diagonal bracing beam in the lower middle rack area. c) Hillandale Farms Corporation, on or about February 26th, 2026 and times prior thereto: The load ratings for racking systems including, but not limited to, the "Butter Storage racking system" and the Coffee creamer/Cheese racking system" were not displayed and/or conveyed to employees.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: a) Hillandale Farms Corporation, on or about February 26th, 2026, and times prior thereto: Employee that were operating a Yale motorized hand truck/pallet jack (Serial # N555401; Model# MPW060LCN24T2748) and Clark brand motorized hand truck/pallet jack were not provided with forklift training prior to operating the motorized hand trucks/pallet jacks. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a) Hillandale Farms Corporation, on or about February 26th, 2026, and times prior thereto: Employees in the warehouse area were exposed to hazards associated with the Yale motorized hand truck/pallet jack (Serial # N555401; Model# MPW060LCN24T2748) that contained a missing cover/door. The open cover/door exposed employees to hazards including but not limited to, electrical shock and malfunctions associated with electrical connections exposed to potential cold/wet conditions. b) Hillandale Farms Corporation, on or about February 26th, 2026, and times prior thereto: Employees in the warehouse area were exposed to hazards associated with the Yale motorized hand truck/pallet jack (Serial # N555401; Model# MPW060LCN24T2748) that contained a defective control handle. The handle was defective in that; it was attached to the frame of the pallet jack with a tarp strap and metal wire to keep it in an upright position. The defective control handle exposed employees to hazards including, but not limited to, potential struck by hazards during work operations with a defective handle.
