(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached. a) On February 25, 2026, the employer failed to ensure that anchor points used as part of a fall protection system were capable of supporting 5,000 pounds per employee attached. An employee performing material?loading tasks was tied off to the building's existing piping for the sprinkler system. As a result, the employee was exposed to fall hazards due to the use of unsafe anchorage points for their personal fall arrest system at a height greater than 6 feet.

29 CFR 1926.502(d) Personal fall arrest systems. (16) Personal fall arrest systems, when stopping a fall, shall: (v): have sufficient strength to withstand twice the potential impact energy of an employee free falling a distance of 6 feet (1.8 m), or the free fall distance permitted by the system, whichever is less. a) On February 25, 2026, the employer failed to ensure that anchor points used as part of a fall protection system had sufficient strength to withstand twice the potential impact energy of an employee free falling a distance of 6 feet. An employee performing elevated material?loading operations was utilizing a personal fall arrest system that was not attached to anchorage points in accordance with the manufacturer's instructions. As a result, the employee was exposed to fall hazards due to the use of unsafe anchorage points for their personal fall arrest system at a height greater than 6 feet.

29 CFR 1926.503(b) Certification of training. (1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training. a) On February 25, 2026, the employer did not ensure that written certification of training records for fall protection were being maintained. The employer did not have training records for employees working at the site location, 830 Murray Street, Portsmouth, OH 45662.

Note: The requirements applicable to construction work under this paragraph are identical to those set forth at §1910.178(l) of this chapter: 29 CFR 1910.178(l)(2) Training program implementation. (ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a) On February 25, 2026, the employer did not ensure that employees operating a material handler received a combination of formal instruction and practical training, nor did the employer evaluate the operators' performance before allowing employees to operate the material handler. As a result, employees were permitted to operate powered industrial trucks without the level of instruction necessary to safely perform powered industrial truck?related tasks, exposing them to potential hazards including collision, tip?over, struck?by incidents, and loss of vehicle control.
