29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed: a) Artisan Acres, Morgantown, WV: On or about February 24, 2026 and at times prior, an employee was exposed to fall hazards of approximately 8 feet while using a portable step ladder for access and egress from a trench box. The ladder side rails did not extend at least 3 feet above the landing surface. No abatement certification or documentation required.
